Delhi Pollution Control Committee Licence is a type of No Objection Certificate (NOC) issued by the Delhi pollution control committee (DPCC) to ensure that that the existing or proposed businesses are not harming the society or the environment. Setting up new industries and ensuring that the production process is set up so that it does not harm the environment and natural habitat.

Overview of Delhi Pollution Control Committee License

Delhi pollution control committee (DPCC) is governed by the Ministry of Environments & Forests & Climate change. DPCC is a self-governing body formed by the Delhi government under the guidance of the Central Pollution Control Committee (CPCC) in 1991. The central pollution control board has approved all its rules and functions to the Delhi pollution control committee.

The main objective of DPCC is to issue a NOC to the existing and new industries & businesses to make sure that any industrial or business activity is not harming the environment and ensuring that it will also not happen in the future.

In recent times there has been a drastic change in the method for living or development or capacity improvement or production procedure or setting up industries or businesses, it is the responsibility of the Entrepreneurs to obtain a pollution control committee license before setting up the business or industry.

As stated under section 25-26 of the Water Prevention & Control of Pollution Act, 1974 Government of India has made it mandatory that no individual can establish any industry involved in the activities of treatment and disposal of waste without obtaining Delhi pollution control committee license from DPCC.

Types of Industries 

Delhi Pollution Control Committee has classified industries in three different categories based on pollution potential. The categories are:

  • White Category 

In this category, the industries come that emits the least amount of pollution into the atmosphere. These types of industries do not require any license or certificate because of their non-polluting nature. White category industries are pesticides, baby carriages, handloom, medical oxygen, etc.

  • Red Category 

The red category industries are not allowed to operate in a delicate environmental area as per the Ministry of Environment & Forest norms. The industries that fall under the red category that has a pollution index of above 60.

  • Green Category 

The industries having a pollution index of 21 to 40 comes under the green category of industries. For green category industries, it is necessary to obtain a pollution control committee license.

  • Orange Category

The industries having a pollution index of 41 to 59 comes under the orange category of industries. For the orange category industries, it is mandatory to obtain a pollution control committee license. 

Necessary Documents for Obtaining Delhi Pollution Control Committee License

  • PAN Card
  • Aadhar Card
  • Certificate issued by the CA.
  • Latest Electricity Bill of the industry.
  • Documents related to the land where the industry or business is being set up, such as Rent agreement, Registration deed, lease agreement, etc.
  • Municipal Corporation of Delhi License necessary for Restaurants only.
  • Validation from the State Pollution Control Board and signed undertaking from the purchaser.
  • The biomedical waste agreement, essential for clinics and hospitals.
  • Delhi medical council certificate, necessary for clinics and hospitals.

Registration Procedure for Obtaining Delhi Pollution Control Committee License 

  • First of all, any Industry looking to obtain a pollution control committee license must verify the business activity.
  • As mentioned earlier, industries are classified into different categories depending on their pollution potential mentioned on the official web page of the Delhi Pollution Control Committee (DPCC).
  • The industries that fall under the white category have to submit the documents on the official online portal, and later undertaking is granted. The business unit has to submit a duly signed hardcopy to the Delhi pollution control committee.
  • For the industries coming under the Green and Orange category, it is essential to check if the location comes under the Industrial area list. If the industry location comes under the industrial area, then the documents must be uploaded on the Delhi pollution control committee’s official website.
  • If the Industry is located in a redevelopment area, an industry assessment letter or SDM letter must be provided to ascertain that it is not located under a redevelopment zone.
  • After all the necessary checking is completed, the proposed industry needs to submit all the necessary documents asked by the authorities depending on the type of industry and its kind of production. After which Consent to Establish (CTE) is produced.
  • Now the proposed industry has to provide a certified hard copy of the duly signed Consent to Establish (CTE) application. After some days Delhi pollution control committee will give a CTE declaration to the proposed industry.
  • Finally, the industries need to analyze pollution control devices in the industry premises and install the equipment for pollution control if necessary. After this, the application of Consent to Operate (CTO) is generated by the proposed industry. The duly signed Consent to Operate (CTO) application is submitted to the Delhi pollution control committee. After the authorities verify the application and if the authorities are satisfied CTO certificate is issued in the name of the proposed Industry.
